Sweepstakes casinos continue to face pushback from regulators.
Pennsylvania has become the latest state to take action against them, creating significant buzz in the gaming industry.
The Pennsylvania Gaming Control Board (PGCB) recently announced during a Gaming Oversight Committee hearing that it has issued 18 cease-and-desist letters to sweepstakes casinos operating within the state.
While these sites may be popular among users, most lack the necessary interactive gaming licenses from the PGCB. However, the PGCB doesn’t have the authority to take legal action like it does against real-money online casinos and sports betting operators. As a result, the board has had to rely on sending cease-and-desist letters.
Understanding Sweepstakes Casinos
Sweepstakes casinos are a special breed of gaming platforms. They operate as play-money social casinos, but with a unique twist—a sweepstakes-based prize layer.
This configuration means that, under federal law, they are not technically considered gambling. However, this hasn’t stopped state legislators and regulators from attempting to close what they perceive as a loophole.
These platforms mainly consist of offshore companies, but some are based in the U.S. and even within Pennsylvania.
As a result, the board has resorted to issuing cease-and-desist letters, and impressively, all 18 companies have complied so far.
Other states have taken matters a step further, crafting legislation to try to regulate sweepstakes and social casinos, or ban them altogether.
The Industry Pushes Back
The PGCB's recent actions haven't gone unnoticed.
The Social and Promotional Games Association (SPGA), which represents the interests of these gaming platforms, has voiced its concern. They argue that Pennsylvania's sweeping regulatory actions do not align with legal precedent or established industry standards seen elsewhere.
SPGA points out that legislative bodies in three other states, including Arkansas and Maine, have recently rejected similar proposals made against sweepstakes casinos. These rejections underscore a crucial oversight in Pennsylvania's current stance—the recognition that properly structured promotional sweepstakes are both legal and safe.
