In West Virginia, you can choose between real money and sweepstakes online casinos. Each offers a unique experience.

Sweepstakes casinos are very popular, but work differently and aren’t as tightly regulated. It appears that West Virginia Attorney General John B. McCuskey wants that to change.

According to a report by iGaming Business, sources told Casino Reports that he subpoenaed “sweepstakes” gaming operators. IGB reports that “There is little information available beyond that.”

West Virginia law does not allow the attorney general to publish the subpoenas. The attorney general can only comment on them after receiving a response from one of the operators.

High 5 Casino Ceases Operations in West Virginia

But a recent move by one of the major players in the sweepstakes casino industry may confirm it.  As of 18 February 2025, High 5 Casino has stopped accepting new sweepstakes players and purchases in six states, including West Virginia. Here's the complete list:

  • Connecticut
  • Delaware
  • New Jersey
  • Pennsylvania
  • Rhode Island
  • West Virginia

A recent post on the SiGMA World X account lays it all out.

The closures come on the heels of the company's decision to shut down in Canadian-regulated markets, as well.

Other States Making Similar Moves

Last week, the Mississippi Senate unanimously decided to ban certain online gaming platforms known as sweepstakes casinos.

Senate Bill 2510 seeks to stop these casinos from operating across the state. While the bill doesn't clearly define sweepstakes casinos, it includes them with any online or computerized gambling games.

Mississippi isn't the first state to attempt banning these casinos; similar bills have been proposed in Connecticut, Maryland, New Jersey, and New York.

Differences Between Online and Sweepstakes Casinos

Real money casinos have strict rules set by the West Virginia Lottery Commission. They require you to deposit real money and winnings are taxed. These casinos are well-regulated to ensure fair play and player safety.

You don’t use real money to play sweepstakes casino games. Instead, you buy tokens or sweep coins to enter games and win prizes, like cash or gift cards. While they offer an alternative way to play, the lack of regulation can increase the risk of scams. However, they still must follow consumer protection laws.

Playing Online Casino Games vs Sweepstakes Casino Games

Both types of casinos offer games like poker, roulette, slots, and blackjack. The gameplay is similar, but real money casinos offer cash rewards, providing an immediate thrill. Sweepstakes casinos feel more casual since the stakes aren’t monetary, which some players prefer.

Real money casinos often feature games from top developers with extras like live dealers and loyalty programs. Sweepstakes casinos might not have these extras, but still offer quality gaming.

How Do Prizes and Payouts Work?

In real money casinos, winnings go directly to your bank account and are reported for taxes. With sweepstakes casinos, you enter draws to win prizes. Some platforms let you exchange winnings for cash, while others offer items or gift cards instead.

Responsible Gambling Always Comes First

Ultimately, whether a player chooses real money, social or sweepstakes casinos in West Virginia (or any other state) depends on their gaming preferences and risk tolerance. Both offer engaging casino experiences, but the choice between them hinges on whether a player prefers the regulated, high-stakes environment of real money casinos or the relaxed, indirect rewards of sweepstakes. In both cases, responsible gaming should always be a priority.
